Foreigners Can Own Property in Mexico — With One Key Structure
American and Canadian buyers often assume they can't own property outright in Mexico.
That's a misconception — but there's an important nuance.
Within 50 kilometers of a coastline or 100 kilometers of a border, foreign nationals must hold property through a fideicomiso — a bank trust that gives the buyer full ownership rights with a Mexican bank acting as trustee.
San Miguel de Allende is in the interior of Mexico. That means foreigners can own property directly, in their own name or through a Mexican corporation.
It's a significant advantage — and one reason international buyers are drawn to the area.
The Notario Is Not Your Closing Attorney
In the United States, closing involves title companies, escrow agents, and attorneys all playing separate roles.
In Mexico, the notario handles most of that process.
A notario publico is a government-appointed legal authority. They verify ownership, review documents, ensure taxes are paid, and officially record the transaction.
The notario represents the transaction — not the buyer or the seller.
That's why having an agent who understands how to protect your interests inside that process matters.
Most Transactions Are Cash
Mexican bank financing for foreign buyers exists — but it's not the norm.
Most international buyers in San Miguel purchase with cash, home equity from a U.S. property, or private financing arranged before they arrive.
If you're planning to finance, get that sorted out before you start looking seriously.
A great property in this market doesn't sit and wait.
Pricing Is in Dollars — But Not Everything Else
Properties in San Miguel are typically listed and priced in U.S. dollars.
But property taxes, utilities, maintenance, and daily life run in Mexican pesos.
The cost of living — especially compared to the U.S. — is one of the most compelling parts of the lifestyle here.

Due Diligence Looks Different Here
There is no MLS in San Miguel the way American buyers are used to.
